Florida Witness Rules for Estate Documents

Florida law requires two witnesses for some of the most important documents a person will sign, including wills, health care surrogate designations, durable powers of attorney and living wills. A document that is not witnessed the way Florida law requires may not be valid, so it is worth arranging witnesses ahead of time.

• Wills: a Florida will must be signed in the presence of two attesting witnesses, who also sign in the presence of the testator and of each other (s. 732.502, Florida Statutes). A will is not invalid just because a witness benefits from it (s. 732.504).
• Health care surrogates and living wills: at least one witness can't be the signer's spouse or blood relative, and the named surrogate can't witness the designation (ss. 765.202 and 765.302, Florida Statutes).
• Powers of attorney: must be signed by the principal and two witnesses and acknowledged before a notary (s. 709.2105, Florida Statutes).
• Ask your attorney who is the best choice to witness each document. I'm a notary, not a lawyer, and I can't give legal advice.

How It Works

1. You refer or schedule: tell us the client's name, the documents and a preferred date, and whether you want Zoom attendance or witness coordination.
2. We confirm with the client: we reach out directly, confirm the details and coordinate any witnesses.
3. Signing appointment: we arrive prepared. If you are attending by Zoom, we connect you before we begin.
4. Delivery and follow-up: scanned documents are emailed the same day, and originals can be sent by tracked courier.
